DMCA Policy

At Ulgulan.in, we respect the intellectual property rights of others and expect our users and visitors to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, Ulgulan.in has adopted the following policy to handle claims of copyright infringement and to provide a process for reporting and responding to such claims.

What is the DMCA?

The DMCA is a United States copyright law that provides a mechanism for copyright holders to notify website owners about alleged copyright infringement. The law also requires website operators to respond to these claims by removing or disabling access to the allegedly infringing content. Although Ulgulan.in is based in India, we respect international copyright laws and adhere to the DMCA guidelines as a best practice to protect creators’ rights.

How to Report Copyright Infringement

If you believe that your copyrighted work has been copied and is accessible on Ulgulan.in in a way that constitutes copyright infringement, you may submit a notification pursuant to the DMCA. To file a claim, please provide the following information in writing to our designated Copyright Agent at:

Your notification must include:

  1. A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed. Please provide sufficient details, such as the title, description, or registration number.
  3. Identification of the material that you claim is infringing and its location on Ulgulan.in (e.g., URL or page).
  4. Your contact information, including your address, telephone number, and email address.
  5. A statement by you that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

How We Respond to DMCA Notices

Upon receiving a valid DMCA takedown notice, Ulgulan.in will take prompt action, which may include:

  • Removing or disabling access to the allegedly infringing content.
  • Notifying the user who posted the content about the complaint.
  • Maintaining a record of the complaint and any correspondence.

Counter-Notification Procedure

If you believe that content removed or disabled as a result of a DMCA notice was mistakenly taken down or that you have the right to use the material, you may file a counter-notification. To do this, send a written communication to our Copyright Agent at ulgulan05@gmail.com including:

  1. Your physical or electronic signature.
  2. Identification of the content that has been removed or disabled and its original location on the site.
  3. A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled due to mistake or misidentification.
  4. Your name, address, telephone number, and email.
  5. Consent to jurisdiction of the federal district court for the judicial district where your address is located, or if you are outside the U.S., to any judicial district where Ulgulan.in may be found.
  6. Agreement to accept service of process from the person who filed the original DMCA notice.

Upon receipt of a valid counter-notification, Ulgulan.in may restore the removed content after 10 to 14 business days, unless the original complainant files a lawsuit seeking to restrain the alleged infringement.

Repeat Infringers

Ulgulan.in respects the rights of copyright holders and complies with the DMCA’s “repeat infringer” policy. Users who are found repeatedly infringing copyright may have their accounts terminated or be subject to other restrictions.
